2. DEFINITIONS

  • “Personal Data” refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains.

  • “Sensitive Personal Data or Information” (SPDI) includes passwords, financial information, or any other detail categorized as such under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

  • “Processing” refers to an automated or manual operation performed on personal data, such as collection, recording, organization, structuring, or storage.

The Company collects data under the legal basis of Contractual Necessity and Legitimate Interest:

  • User-Provided Information: Including but not limited to, Name, Tax Identification Numbers (GST/PAN), billing/shipping coordinates, and electronic communication metadata.

  • Production Artifacts: High-resolution digital assets, schematics, and proprietary designs uploaded for the execution of print services.

  • Automated Telemetry: IP addresses, browser fingerprints, session durations, and “Cookies” (HTTP headers) for the purpose of fraud prevention and analytical optimization.

4. PROCESSING AND PURPOSE LIMITATION

The Company adheres to the principle of Purpose Limitation. Data shall be processed strictly for:

  • Execution of the Service Level Agreement (SLA) (i.e., order fulfillment).

  • Compliance with statutory fiscal obligations and audits.

  • The enhancement of technical Platform architecture via machine learning and traffic analysis.

5. INTELLECTUAL PROPERTY AND CONTENT INDEMNIFICATION

As a specialized print service provider, the Company operates as a Passive Conduit.

  • Warranty of Ownership: The User represents and warrants that they possess all necessary licenses, rights, and consents for any content uploaded to the Platform.

  • Indemnification: The User shall defend, indemnify, and hold harmless Bharat Printing Press, its directors, and affiliates from and against any third-party claims, including intellectual property infringement, defamation, or violation of privacy rights arising from the User’s submitted content.

6. TECHNICAL AND ORGANIZATIONAL SECURITY MEASURES (TOMs)

The Company employs robust security protocols to ensure the Integrity and Confidentiality of data:

  • Encryption: Implementation of Transport Layer Security (TLS 1.3) for data-in-transit and AES-256 encryption for data-at-rest.

  • Access Control: Strict Role-Based Access Control (RBAC) mechanisms to ensure only authorized personnel handle User designs.

  • Anonymization: Aggregated data used for marketing analytics is subject to rigorous de-identification processes.

7. DATA DISCLOSURE AND THIRD-PARTY TRANSFERS

The Company does not trade in Personal Data. Disclosure is restricted to:

  • Authorized Processors: Logistics partners and PCI-DSS compliant payment gateways under strict Non-Disclosure Agreements (NDAs).

  • Legal Mandates: Compliance with judicial orders, warrants, or statutory requirements from law enforcement agencies.

8. USER RIGHTS AND DATA PRINCIPAL REQUESTS

Under the DPDP Act and relevant regulations, Users (Data Principals) hold the following rights:

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Bharat Printing Press shall not be held liable for any indirect, consequential, or punitive damages, including but not limited to loss of profits or data breaches resulting from factors beyond the Company’s reasonable control (Force Majeure) or third-party interventions.

10. GOVERNING LAW AND DISPUTE RESOLUTION
